Customer can make any design changes to the web design order, during the development of the Website. However changes requested after the design was approved for the customer will carry a discretionary fee.

Customers can change the service order at any time before the service is performed.
- Hosting Account
Customers not enrolled on any special discount program can change their hosting level or move out to a different provider at any time without any penalties. Limitations apply to the customers enrolled on the free website program and the 25% off program.
3-DISCLAIMER OF LIMITATIONS
| Cancellation |
- Web Design:
If customer cancel the website design order after the 24 hour money back guarantee period expired, and if the work already started, the money will be returned, but there will be a discretionary $50.00 late cancellation fee debited for the standard design and $100.00 for the others types of designs.

- E-Commerce:
If customer cancel the website design order after the 24 hour money back guarantee period expired, and if the work already started, the money will be returned, but there will be a discretionary $50.00 late cancellation fee debited.
Any fees paid for software bought for the customer application, or any setup fees paid to the payment gateway to setup the account will not be returned.
- Web Hosting:
You can cancel the hosting at any time, the monthly charges will apply, but any remaining money from any prepay payment will be returned ( Applies to quarterly, semiannually, and yearly payments).

- Domain Registration
Domain registration fee is not refundable. (Sorry, we don't get the money back from the registrar because you assume ownership of the domain name when you register the name)
4-PAYMENTS AND CREDITS

Must be requested in e-mail to the customer service department with a good reason, if approved the effect is not retroactive on a pass due account. ( Applies only to current customers after three months of service)
5-CONTENT AND USES
As a condition of Your use of Webcom Unlimited LLC ’s Software and Services, You agree not to use them for any purpose that is unlawful or prohibited by these terms and conditions, and You agree to comply with any applicable local, state, federal and international laws, government rules or requirements. You agree You will not be entitled to a refund of any fees paid to Webcom Unlimited LLC if, for any reason, Webcom Unlimited LLC takes corrective action with respect to Your improper or illegal use of its Services.
- We are not hosting adult XXX content at this time, nor designing adult XXX content.
- Spamming, Hotlinking, Hacking, Bandwidth Stealing or any other illegal and unethical practices are prohibited and severely punished.
- We do not design or host websites which content denigrates or insults any ethnic group; race; sexual preferences or country.
6-DISCLAIMER OF WARRANTIES
6.1| Availability of the Hosting Services |
Subject to the terms and conditions of this Agreement, Webcom Unlimited LLC shall attempt to provide the Services for twenty-four (24) hours per day, seven (7) days per week throughout the term of this Agreement. You agree that from time to time the Services may be inaccessible or inoperable for any reason, including, without limitation: (i) equipment malfunctions; (ii) periodic maintenance procedures or repairs that Webcom Unlimited LLC may undertake from time to time; or (iii) causes beyond the control of Webcom Unlimited LLC or that are not reasonably foreseeable by Webcom Unlimited LLC, including, without limitation, interruption or failure of telecommunication or digital transmission links, hostile network attacks network congestion or other failures.

You agree that Webcom Unlimited LLC has no control of availability of the Services on a continuous or uninterrupted basis.
6.2| Limitation of Liability |
We the company Webcom Unlimited LLC, webmaster, developers and associates shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Webcom Unlimited LLC has been advised of the possibility of such damages), resulting from:
(I) the use or the inability to use any of our services
(II) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service.
(III) unauthorized and fraudulent access to or alteration of your transmissions or data.
(IV) statements or conduct of any third party on the service
(V) any damages to your business resulting from the action of criminals or natural disasters.
6.3| Content ownership |
Customer assumes ownership of the web design content after full payment of the design.
6.4| Length of work |
Maximum prorated duration for a web design project is 2 months and we assume no liability for delays caused by the inability of the customer to get the materials for the designer on time (ex. pictures, text or other media that the customer wants to put into the website) we reserve the right to charge a $75.00 fee for every extra month that we expend on a project due to customer delays on content delivery.
If the delay is caused by Webcom Unlimited (ex. sick developer, leave of absence, etc) , we will cancel the job and give full refund to the customer. We will also give the customer a 5% discount of the full price for a future order.
6.5| Indemnification |
You agree to defend, indemnify and hold harmless Webcom Unlimited LLC and its contractors, agents, employees, officers, directors, shareholders, and affiliates from any loss, liability, damages or expense, including reasonable attorneys' fees, resulting from any third party claim, action, proceeding or demand related to Your (including Your agents affiliates, or anyone using Your account, software or services with Webcom Unlimited LLC whether or not on Your behalf, and whether or not with Your permission) use of the Software or Services You purchased from Webcom Unlimited LLC or Your breach of this Agreement or incorporated agreements and policies. In addition, You agree to indemnify and hold Webcom Unlimited LLC harmless from any loss, liability, damages or expense, including reasonable attorneys' fees, arising out of any breach of any representation or warranty provided herein, any negligence or willful misconduct by You, or any allegation that Your account infringes a third person's copyright, trademark or proprietary or intellectual property right, or misappropriates a third person's trade secrets. This indemnification is in addition to any indemnification required of You elsewhere. Should Webcom Unlimited LLC be notified of a pending law suit, or receive notice of the filing of a law suit, Webcom Unlimited LLC may seek a written confirmation from You concerning Your obligation to indemnify Webcom Unlimited LLC . Your failure to provide such a confirmation may be considered a breach of this agreement. You agree that Webcom Unlimited LLC shall have the right to participate in the defense of any such claim through counsel of its own choosing. You agree to notify Webcom Unlimited LLC of any such claim promptly in writing and to allow Webcom Unlimited LLC to control the proceedings. You agree to cooperate fully with Webcom Unlimited LLC during such proceedings.
